Rental Conditions at TikTakRent
📝 General Provisions and Rental Agreement
- These General Rental Conditions (hereinafter "GRC") define the rules for renting equipment (hereinafter "Equipment") offered by TikTakRent, with its registered office in Krakow (hereinafter "Lessor").
- The Client (hereinafter "Renter") can be a natural person with full legal capacity, a legal entity, or an organizational unit without legal personality.
- The Equipment Rental Agreement (hereinafter "Agreement") is concluded in writing or document form (e.g., by online acceptance of the GRC and booking confirmation) at the Lessor's rental point or remotely, if the Lessor offers such a possibility.
- To conclude the Agreement, a Renter who is a natural person is required to present a valid photo identification document (e.g., ID card, passport). In the case of foreign nationals or in other justified cases, the Lessor may request an additional document or payment of a refundable security deposit. The amount of the deposit is specified in the Lessor's price list.
- The Renter declares that they have read these GRC and the Equipment operating instructions and accepts their provisions.
📦 Handover and Acceptance of Equipment
- The Lessor undertakes to provide the Renter with Equipment that is technically sound, complete, and clean.
- The technical condition, completeness, and any existing minor damage to the Equipment are verified by both Parties and described in a handover protocol (or other document confirming handover), signed by the Renter and the Lessor upon handover of the Equipment.
- Signing the protocol by the Renter confirms receipt of Equipment compliant with the Agreement and without visible defects, unless such defects were noted in the protocol.
- The Lessor provides the Renter with instructions on the proper and safe use of the Equipment.
🕒 Rental Period and Extension
- The rental period for the Equipment is calculated from the moment specified in the Agreement or the handover protocol.
- Extension of the rental period is possible only with the Lessor's consent and after agreeing on new terms, including the fee for the additional period. The Renter should notify the Lessor of their wish to extend the rental period before the original rental term expires.
- In the absence of notification of the wish to extend and failure to return the Equipment on time, the Lessor is entitled to charge a fee for unauthorized use of the Equipment in the amount specified in the price list.
🔁 Return of Equipment
- The Renter is obliged to return the Equipment to the Lessor by the deadline specified in the Agreement, in a condition not worse than that resulting from proper use (normal wear and tear), clean, and complete with all accessories.
- The return of the Equipment is confirmed by a handover protocol signed by both Parties.
- In the event of returning Equipment that is dirty, damaged, or incomplete, the Lessor is entitled to charge the Renter for the costs of cleaning, repair, or replacement of missing parts, according to the price list or individual valuation.
🔁 Renter's Liability
- The Renter bears full responsibility for the Equipment from the moment of its acceptance until its return to the Lessor.
- The Renter is obliged to use the Equipment in accordance with its intended purpose, the operating instructions, and safety rules, as well as to protect the Equipment against loss, destruction, or damage.
- In the event of damage, destruction, or loss of the Equipment (including theft), the Renter is obliged to immediately inform the Lessor and to cover the damage in full (repair costs or the equivalent value of new Equipment if repair is impossible or uneconomical).
- The Lessor may deduct amounts due for damages from the paid security deposit. If the damage exceeds the value of the deposit, the Renter is obliged to pay the difference.
- It is prohibited to make the Equipment available to third parties without the Lessor's consent, or to make any alterations or repairs to the Equipment.
📝 Final Provisions
- In matters not regulated by these GRC and the Agreement, the provisions of the Polish Civil Code shall apply.
- The Parties will endeavor to resolve any disputes arising from the Agreement amicably. In the absence of an agreement, disputes will be settled by the court competent for the Lessor's registered office or in accordance with applicable regulations.
- The Lessor reserves the right to amend these GRC. Amendments to the GRC are effective from the moment of their publication on the Lessor's website or at the rental point and apply to agreements concluded after that date.
